Description: In this sweeping study of the judicial opinion, William D. Popkin examines how judges' opinions have been presented from the early American Republic to the present. Throughout history, he maintains, judges have presented their opinions within political contexts that involve projecting judicial authority to the external public, yet within a professional legal culture that requires opinions to develop judicial law through particular institutional and individual judicial styles. Tracing the history of judicial opinion from its roots in English common law, Popkin documents a general shift from unofficially reported oral opinions, to semi-official reports, to the U.S. Supreme Court's adoption in the early nineteenth century of generally unanimous opinions. While this institutional base was firmly established by the twentieth century, Popkin suggests that the modern U.S. judicial opinion has reverted—in some respects—to one in which each judge expresses an individual point of view. Ultimately, he concludes that a shift from an authoritative to a more personal and exploratory individual style of writing opinions is consistent with a more democratic judicial institution.

Description: The extraordinary recent increase in rates of cohabitation and non-marital birth presents a major challenge to traditional family law principles, and the legal rules governing cohabitation are thus among the most hotly contested areas of family law and policy today. In many nations, courts, legislatures, and law-reform bodies are "reinventing" common law marriage, seemingly without any sense of its history, doctrinal development, or limitations. The current law surrounding common law marriage is extremely complex. Professor Göran Lind has undertaken the demanding task of writing the most well-researched text on this topic to date. Separated into three Parts, Common Law Marriage covers the origins of the doctrine, its legal aspects in modern America, and the future of cohabitation law across the globe and in the 11 American jurisdictions that currently recognize common law marriage. It provides a cultural and historical history of the subject, from Ancient Roman Law to Medieval Canon Law, and analyzes over 2,000 American cases which have utilized the doctrine. This timely book is an excellent resource for scholars, legislators, and policymakers who are interested in the complex legalities of common law marriage.

Description: The first book of its kind dedicated to an assessment of the legality of boxing, The Legality of Boxing: A Punch Drunk Love? assesses the legal response to prize fighting and undertakes a current analysis of the status of boxing in both criminal legal theory and practice. In this book, Anderson exposes boxing’s 'exemption' from contemporary legal and social norms. Reviewing all aspects of boxing - historical, legal, moral, ethical, philosophical, medical, racial and regulatory - he concludes that the supposition that boxing has a (consensual) immunity from the ordinary law of violence, based primarily on its social utility as a recognised sport, is not as robust as is usually assumed. It: suggests that the sport is extremely vulnerable to prosecution and might in fact already be illegal under English criminal law outlines the physical and financial exploitation suffered by individual boxers both inside and outside the ring, suggesting that standard boxing contracts are coercive thus illegal and that boxers do not give adequate levels of informed consent to participate advocates a number of fundamental reforms, including possibly that the sport will have to consider banning blows to the head proposes the creation of a national boxing commission in the US and a similar entity in the United Kingdom, which together would attempt to restore the credibility of a sport long know as the red-light district of sports administration. An excellent book, it is a must read for all those studying sports law, popular culture and the law and jurisprudence.

Description: These proceedings cover the lectures delivered at the Fourth International Summer College on Physics and Contemporary Needs held from June 16 - July 4, 1979 at Nathiagali, one of the scenic hill resorts in the northern part of Pakistan. The college was organised by Pakistan Atomic Energy Commission (PAEC) and co-sponsored by the International Centre for Theoretical Physics, Trieste (ICTP), Italy. It also received a financial grant from the University Grants Commi ssion for the participation of physicists from various universities of Pakistan. The college was attended by 16 lecturers and invited seminar speakers. It was attended by 186 participants from 28 coun tries and consisted of 15 concentrated days of lectures, seminars and informal discussions. These proceedings contain only regular lectures delivered at Nathiagali but the seminars held there are listed in the Appendix. This year the college put special emphasis on various energy systems, including their long term implications, and computer software. However, the lectures delivered at the college also covered a wide spectrum of physics. The series of the colleges of which the present college is the fourth one are an attempt to remove the barrier of isolation for the physicists working in developing coun tries, far removed from active centres of research. Thus these colleges could help to fill the important gap in communication between the physicists of developing and advanced countries.

Description: As the waters of the Mississippi River and Lake Pontchartrain began to pour into New Orleans, people began asking the big question--could any of this have been avoided? How much of the damage from Hurricane Katrina was bad luck, and how much was poor city planning? Steinberg's Acts of God is a provocative history of natural disasters in the United States. This revised edition features a new chapter analyzing the failed response to Hurricane Katrina, a disaster Steinberg warned could happen when the book first was published. Focusing on America's worst natural disasters, Steinberg argues that it is wrong to see these tragedies as random outbursts of nature's violence or expressions of divine judgment. He reveals how the decisions of business leaders and government officials have paved the way for the greater losses of life and property, especially among those least able to withstand such blows--America's poor, elderly, and minorities. Seeing nature or God as the primary culprit, Steinberg explains, has helped to hide the fact that some Americans are simply better able to protect themselves from the violence of nature than others. In the face of revelations about how the federal government mishandled the Katrina calamity, this book is a must-read before further wind and water sweep away more lives. Acts of God is a call to action that needs desperately to be heard.

Description: This book is an experienced analysis of the failures of American schools to provide learning for a majority of its students including those known as the forgotten halfand the reasons for those failures. It explores who is being educated, and what is known about learning in terms of prerequisites, brain differences and cultures. The book describes the failed initiatives of more money, class size reduction, school choice, magnet schools, vouchers, and merit pay for teachers. Charter schools dont cut it for a majority of our children. No Child Left Behind (NCLB) and Race To the Top (RTT) are expensive, unmitigated disasters. The American schools have mostly missed the promise of change and technology and are now engaged in massive fallacious testing, resulting in little benefit to the nation and significant harm to the children. Outrageously priced Higher Education has little to offer to improve the national education malaise, and lumbers on in its dismal, disorderly state. However, American schools in their INNOCENCE are a product of and restricted by their governmental, economic, civic, and ecologic environment. As described in the closure of the book, The Future, the major structural changes needed to re-create our national learning system have overrun national planning and thinking capacity. Fortunately, there are promising patterns of change in progress.
